Terms of Use

Last updated August 13, 2026

These Terms of Use ("Terms") govern your use of procutmetal.ca and any work order, quote, or sign-off form provided by Procut Moulding & Metal Inc. ("Procut," "we," "us," or "our"), of 16145 114 Ave NW, Edmonton, Alberta, T5M 2Z3, Canada. By using this website or by signing a Procut work order, whether in person on our shop tablet or remotely through an emailed signing link, you agree to these Terms.

1. Our Services

Procut fabricates custom metal flashing, moulding, and stucco accessories for Alberta contractors, masons, and stucco applicators. Content on this website (pricing ranges, product descriptions, colour charts) is informational and does not itself constitute a binding order. A binding order is created only when a work order sign-off has been signed, either in person at our shop or remotely through the process described below.

2. Electronic Signatures & Electronic Records

Procut records work order sign-offs electronically in one of two ways:

  • In-person sign-off: both you and a Procut staff member sign directly on a tablet at our shop, and the completed document is generated immediately.
  • Remote sign-off (phone orders): Procut staff record the order and sign first; you then receive a unique, one-time email link to review the order and add your signature from your own device.

By checking the consent box and signing through either method, you agree that:

  • You consent to conduct this transaction electronically and to sign this document using an electronic signature, in place of a handwritten signature.
  • Your electronic signature, and the electronic record it is attached to, is legally binding, valid, and enforceable to the same extent as a handwritten signature on paper, in accordance with Alberta's Electronic Transactions Act (SA 2001, c E-5.5) and applicable Canadian law.
  • You have read and reviewed the order details shown to you (line items, products, quantities, pricing, and any attached sketches) before signing, and that the signed document accurately reflects your agreement.

To help establish the authenticity and integrity of each signature if it is ever disputed, Procut records the following alongside the signature image itself: the date and time of signing, the IP address and browser/device information the signature was submitted from, and the specific version of these Terms that was in effect and accepted at the time. This information, together with the signed PDF document, is retained by Procut as its business record of the transaction and may be produced as evidence of the agreement, including in court or other legal proceedings.

You may request a paper copy of any signed work order, free of charge, by contacting us using the details in Section 7. If you do not wish to sign electronically, please tell shop staff before signing so a paper alternative can be arranged.

3. Pricing on Work Orders

Any total shown on a work order or sign-off page before it is finalized is an estimate based on the unit prices and quantities entered by staff. It does not include applicable taxes or shipping and delivery charges, which, where they apply, are calculated and confirmed separately. Your final invoiced total may differ from the estimate shown at sign-off time.

4. Acceptable Use

You agree not to misuse this website or the remote signing link sent to you — including by attempting to access another customer's order or signing link, submitting false information, or interfering with the normal operation of the site.

5. Intellectual Property

The text, images, and design of procutmetal.ca are owned by Procut Moulding & Metal Inc. or used with permission, and may not be copied or reused without our consent.

6. Limitation of Liability & Governing Law

This website and its content are provided "as is." To the extent permitted by law, Procut is not liable for indirect or consequential losses arising from your use of this site. Nothing in this section limits liability that cannot be limited under Alberta law.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. You agree that the courts of Alberta have exclusive jurisdiction over any dispute arising from these Terms or a signed work order.

7. Changes & Contact

We may update these Terms from time to time; the "Last updated" date above reflects the current version. Changes do not affect the terms that applied to a work order already signed — see Section 2 for how we record which version applied to a given signature.

Questions about these Terms, or requests for a paper copy of a signed document, can be sent to [email protected] or by calling (780) 452-0160.
